1. Acceptance of Terms

These Terms of Use govern your access to and use of the Ceibaa platform, mobile applications, websites, services, and related features (collectively, the "Platform"). By creating an account, registering, browsing, or using any service offered by Ceibaa, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable Indian laws, including the Information Technology Act, 2000 and the rules and regulations framed thereunder.

If you do not agree with these Terms, you must not access or use the Platform. Ceibaa reserves the right to restrict or terminate access for any person who fails to comply with these Terms.

2. Eligibility and Account Registration

You must be at least 13 years of age to use the Platform, and if you are under 18 years of age, you may use the Platform only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. You are required to provide accurate, current, and complete information during registration and to maintain the same throughout your use of the Platform.

You are solely responsible for all activity conducted through your account and for maintaining the confidentiality of your login credentials. You must notify Ceibaa immediately if you become aware of any unauthorized access or breach of your account.

3. Description of Services

Ceibaa provides educational, assessment, learning, and community-related services, including but not limited to:

• Practice tests, mock exams, quizzes, and academic content
• Study resources, progress tracking, and recommendation features
• Live quiz battles, community interaction, and social engagement features
• Subscription or paid access to premium content and services, where applicable

Ceibaa may modify, suspend, or discontinue any feature or service at any time, without prior notice, to improve functionality, maintain compliance, or manage operational requirements.

4. User Conduct

You agree not to:

• Use the Platform for unlawful, fraudulent, or abusive purposes
• Access or attempt to access another person’s account without authorization
• Post or share offensive, defamatory, hateful, discriminatory, or harmful content
• Distribute, copy, scrape, reverse engineer, or resell Platform content without permission
• Use bots, scripts, or automated tools to interfere with Platform function or performance
• Manipulate quiz results, cheating mechanisms, or rankings in violation of exam integrity rules

Ceibaa may remove content, restrict access, or suspend a user account if such conduct is detected or reported.

5. Payment, Subscriptions, and Refunds

Where the Platform offers paid subscriptions, course access, or other commercial features, you agree to pay all applicable fees and taxes required under Indian law. Subscription plans, billing cycles, and cancellation terms will be clearly communicated before purchase.

Refunds, if any, will be processed in accordance with the applicable plan terms, platform policy, and legal requirements. Ceibaa may refuse a refund where there is misuse, unauthorized access, or repeated cancellations without valid reason.

6. Intellectual Property

All content, materials, software, trademarks, designs, logos, dashboards, quizzes, question banks, and related features available on the Platform are the property of Ceibaa or its licensors and are protected under applicable intellectual property laws in India and internationally.

You may not copy, reproduce, publish, distribute, modify, sell, or create derivative works from any Platform content unless expressly authorized in writing by Ceibaa. User-generated content remains owned by the user, but by posting it on the Platform, you grant Ceibaa a limited license to host, display, and operate such content as necessary to provide the services.

7. Privacy and Data Processing

Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to the collection, storage, processing, and use of your personal information in accordance with applicable Indian laws, including the Digital Personal Data Protection Act, 2023, and the rules framed thereunder.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. Ceibaa does not warrant that the service will be uninterrupted, error-free, or free from viruses, downtime, or technical issues. We also do not guarantee that any academic results, recommendations, performance analytics, or rankings will be accurate or outcome-based in every case.

We aim to maintain service quality and security, but users should exercise their own judgment when relying on educational content, test scores, or community information.

9. Limitation of Liability

To the maximum extent permitted by law, Ceibaa, its affiliates, officers, directors, employees, and representatives shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use or inability to use the Platform, including loss of data, loss of academic progress, reputational damage, or financial loss, except where liability cannot be excluded under applicable Indian law.

10. Indemnification and Security

You agree to indemnify and hold harmless Ceibaa from any claims, liabilities, damages, losses, or expenses arising out of your misuse of the Platform, violation of these Terms, infringement of third-party rights, or failure to comply with applicable laws.

Ceibaa shall take reasonable technical and organizational measures to protect user information; however, no online service can guarantee absolute security. You agree that Ceibaa is not liable for losses resulting from unauthorized access beyond our reasonable control.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in India.

In the event of a dispute, we encourage you to contact us first so that a mutually satisfactory resolution can be reached before formal legal action.

12. Changes to Terms

Ceibaa may revise these Terms from time to time to reflect changes in services, legal requirements, or operational needs. Material changes will be communicated through the Platform or by email, where applicable. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
